The present general conditions regulate the use of the service of StreetMatching, as well as the conditions in the terms of use of the personal data provided through the use of our website.
StreetMatching can be used by registered users only. You can access our services from your mobile phone.
By entering the website StreetMatching the user is accepting the terms and conditions of this website.
StreetMatching reserves the right to amend the terms and conditions without previous notice. The User must check if there have been any changes in the terms and conditions every time they access the website of StreetMatching.

1. Terms of use

The access to StreetMatching is limited to users over 16. Therefore, when registering, you agree to comply with this requirement and you accept the consequences it may result in if it were not this way. Likewise, you will have to check the age limit in your country for users who are between 16 and 17 years old. And, if so, do not sign up on StreetMatching
In order to access our services, StreetMatching offers the User a registered system in which he/she must provide personal information and create an access code with user name and password. You can access our registered system through our website clicking 'join now'.

After signing up, users can set up their profiles. Creating a profile requires uploading a recent photograph where the user can be easily identified.
StreetMatching works using several sections available to the user account: Register Crush, Activity, Contacts, Mail, Places & Events and Configuration.
The Notify Crushes function lets each user enter the approximate date, time and place where they have seen people they are interested in. After completing these fields, the user can also add a description of the crush's recipient. Descriptions are shared with the StreetMatching community, at the StreetMatching home page and on Twitter, anonymously.
StreetMatching reserves the right to delete and edit any descriptions as it sees fit.
If users so wish, they can share their crush with friends on Twitter and Facebook.
Finally, in this section users can choose whether they allow their crush description to be commented by other community members. They can also add their profile photo to the crush if they wish. If the photo is posted, it will be displayed together with the crush description to other community users. People who are not registered may also see the photo if they access the website's main page or the crush (e.g. if it has been shared on Facebook or Twitter).

The Crushes section shows the crushes logged by the user.
For each reported crush (same date and similar time and place), each user is shown snapshots of similar members matching their gender interests.
If a logged crush has no matching crush, StreetMathing sends the user a tip.
Users can write and send their own tips if they so wish, randomly showing other users that they have no matches when logging crushes. Tips feature each user's nickname. Tips provided by users are validated by the StreetMatching team before being posted. StreetMatching reserves the right to post or not post tips, and to edit them where it may deem appropriate.
In this same section community crushes are displayed to the user, including descriptions that other StreetMatching users have offered about their crushes. In these cases users can wish them luck and add a comment to the description, provided the person sending the crush has previously selected the "Allow other users to comment on this crush" option.
Comments regarding the descriptions of other users are posted under each user's nickname.
StreetMatching reserves the right to delete any comments it may deem inappropriate.
Moreover, the author of each comment and the author of that crush may also delete any comments as they may see fit.
Streetmatching shall keep a record of the date, time and place logged by users until the user deletes the crush.
Accepted users are available in the Matches section, and can communicate with each other using StreetMatching's Mail function.
Users can update their profile information in the Setup section.
Some information, like the nickname, date of birth and gender, cannot be changed.

- The User is the only responsible for his/her account in StreetMatching and the information that is shown in it as well as the user name and password.
- The User ensures at all times that the personal information that he/she provides to StreetMatching is precise and trustful.
- It is strictly forbidden to publish or spread information, photographs or any other contents that, according to StreetMatching, attempts against moral, public order and good habits.
- It is strictly forbidden to publish or spread personal data including images or photographs or any information of third parties or other Users that you may be familiar with during the time you used the website of StreetMatching.
- It is strictly forbidden to publish or spread any advertising or commercial concept that is inconsistent with the aim of StreetMatching.
StreetMatching reserves the right to cancel the users account and all the information related in case it detects or sees unlawful and damaging contents for the image of StreetMatching and /or its products or the ones of third parties, as well as contents that can be offensive or that incite and advertise illegal or slanderous activities, pornographic or violent contents that incite discrimination regarding race, ethnic group, gender, creed or sexual orientation.

2. Privacy Policy

This privacy policy governs for the Website StreetMatching but not for websites governed by other entities, organizations or third parties.
According to the provisions set forth by the Organic law 15/1999 of 13 December on the Protection of Personal Data the clients or users are informed and agree that all data obtained by means of user registration and during the use of StreetMatching will be incorporated and stored in an automated data file, property of Mc Guffin Estudio Audiovisual, S.L.
By voluntarily providing personal information, the User agrees to the processing of the information by Mc Guffin Estudio Audiovisual, S.L. with the aim of managing the use of StreetMatching as well as receiving information or news related to the Website of StreetMatching by any via, including email address.

Some of the information provided voluntarily by the User, under his/her own responsibility, will reveal information that can be sensitive, such as: sexual orientation, religion, ethnic group, among others. In this sense, the User agrees to the processing of information by StreetMatching with the aim of managing the services offered by our website.
StreetMatching guarantees the absolute confidentiality and privacy of the personal information of our Users and, due to that, safety measures have been taken to prevent the alteration, loss, processing or unauthorized use to guarantee the integrity and safety, especially the measures set forth by the Royal Decree 1720/2007 of the 21 of December by which the Organic Law 15/1999 of the 13 of December on the Protection of Personal Data is approved.
Notwithstanding, StreetMatching will not, in any case, be responsible for the effects that may arise around the personal information when these are derived from an unauthorized access to the system making it impossible to detect by the security measures established, or when it is due to a lack of diligence by the User with regard to the guardianship and custody of his/her access code and of his/her own personal information.
To sign up, the users must enter his/her details in the fields requested. Not sharing this information with StreetMatching may result in the impossibility of our Website to provide you with our services.

Only users who have been previously authorized by another user may have access to the profile information, consisting of: nickname, gender, sexual orientation and photo. Users can delete any other user from their contact list any time they wish. Deleting a contact also deletes all information and communications between the users. That is, no user will be able to see the information they sent or received. Users may, at any time, exercise their right to access, correct, object to or cancel the information in the terms provided for by the Spanish Organic Data Protection Law, by making the appropriate request via email to the address legal@streetmatching.com, indicating "data protection" in the "about" line and attaching a copy of the user's national identity card or equivalent identifying document.

The User is responsible for maintaining the confidentiality of his/her password and assumes entire responsibility for any or all actions when derived from the disclosure of passwords.
The user may change the password anytime. The User agrees to notify StreetMatching immediately of any unauthorized use of his/her account or any other breach of security. StreerMatching will not be responsible if someone else uses your account or password.

StreetMatching Website uses an automatic collection of information not directly provided by the users, known as 'cookies'.
A cookie is a small text file that is placed on your hard disk or on the browser memory in the setup file of the disk operating system to identify the User. Although cookies do not contain comprehensible information, they enable us to associate the users identity to the personal information stored in the web.
Cookies are stored in a server where only StreetMatching has access to, and StreetMatching is the only one that can access or handle the information collected from the cookies but in a completely anonymous way, with the only aim of improving our services and that of the website in relation to the demands and preferences of our Users.
If the User does not want cookies stored in his/her computer, he /she will have to set the computer browser to reject the cookies.

3. Disclaimer of Liability

StreetMatching assumes that the data contained in the website was introduced by the holder and is reliable and accurate. Therefore, the User is the only responsible for the information and/or contents provided to us when signing in and during the use of the services provided by StreetMatching. In no event shall StreetMatching be liable for the inaccuracy of the information provided by the Users.
Consequently, and to the fullest extent of the Spanish law, StreetMatching will not be liable for any loss, damage, costs, direct or indirect costs incurred by the User or any other third party, whether they are caused or related to the access or use of the web site StreetMatching, or by the information contained in it, or by any other cause, regardless of the way it is caused. In no circumstances shall StreetMatching be responsible for the general or specific damage.

4. Intellectual Property

All rights of intellectual property from the website StreetMatching such as trademarks, design, logos and trade names or belong to StreetMatching, S.L. or they have been licensed-out to third parties. It is therefore strictly forbidden to copy or reproduce in any manner without authorization.

5. Governing Law and Jurisdiction

The general conditions from this website shall be governed by, and construed, in accordance with the laws of Spain. Whatever controversy derived from the use of the website StreetMatching as well as any other matter that may arouse with regard to the interpretation, application and in compliance with the current general conditions, the users shall subject themselves to the courts of the city of Barcelona (Spain).
